Reckless drivers create a high risk of harm

Section 14-222 of the Connecticut Code governing reckless driving does not specifically define what actions are considered reckless, except for two circumstances of speeding. Reckless driving is generally a subjective charge, meaning that it is up to the police officer to decide whether the behavior endangered the lives of others or was the primary cause of the car accident in which you were injured. Generally, any action that puts others at risk of harm might be charged as reckless, including:

  • Changing lanes frequently
  • Swerving over divider lines
  • Tailgating
  • Driving while distracted by an inappropriate activity
  • Texting while driving
  • Talking on the cellphone while driving
  • Driving an automobile that the driver knows is defective
  • Speeding

Speeding is specifically defined as reckless driving in Connecticut statutes

Connecticut law clearly defines two speeding violations for which the driver is presumed to be reckless as a matter of law. Under the state’s motor vehicle codes, driving 85 mph or faster is automatically reckless driving, no matter what the circumstances surrounding the situation. Driving a car at a speed that endangers the life of another person can also be charged as reckless.
